Terms of Service

1. Parties and Definitions

These Terms of Service ("Terms") are entered into between Keskintech Marketplaces (Furkan Keskintaş, SUNAY MAH. ERZURUM CAD. I BLOK NO: 15 I İÇ KAPI NO: 5 MERKEZ/ MUŞ "Keskintech", "we" or "the platform") and the individual or legal entity registering for the service ("User" or "you").

Key terms used in these Terms:

  • Platform: The keskintechmarketplaces.com website and management dashboard
  • API Gateway (apigw): The paid SaaS infrastructure connecting the User's e-commerce store (WooCommerce and other supported platforms) to marketplaces
  • Plugin: The free WordPress plugin distributed under the GPL licence via WordPress.org, and related apps or plugins for other supported platforms (such as Shopify and OpenCart) made available over time
  • Subscription: A monthly, 3-month or annual paid plan granting access to the apigw service
  • Marketplace: Trendyol, Pazarama and other e-commerce marketplaces added over time

2. Service Description

Keskintech Marketplaces is a SaaS platform that integrates WooCommerce and other supported e-commerce platforms with Turkish and global marketplaces. The service includes:

  • Product listing and updating product information on marketplaces (stock, price, description, images and other fields)
  • Order retrieval from marketplaces and import into your e-commerce platform
  • Secure encrypted storage and management of API credentials
  • In-platform support ticketing and notification system

The WordPress plugin is provided free of charge under the GPL v2 licence via WordPress.org. Plugins and apps for Shopify, OpenCart and other platforms will be added over time. The plugin's core features can be used without a subscription. However, marketplace API integration (product listing, stock/price updates, order retrieval, etc.) requires an active Keskintech Marketplaces apigw subscription.

3. Account & Membership

To register, you must be at least 18 years old and provide a valid email address. You are responsible for ensuring that all registration information is accurate and kept up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you become aware of any unauthorised access, notify us immediately at info@keskintechmarketplaces.com.

Each account belongs to a single user or business entity. Transfer or sharing of accounts is prohibited.

4. Subscription & Payment

Keskintech Marketplaces offers the following subscription periods:

  • Monthly — renews every month
  • 3-month — renews every three months
  • Annual — renews every year

All subscription plans include the same features and service scope.

Payments are processed by iyzico, a payment institution licensed by the Turkish Banking Regulation and Supervision Agency (BDDK). We do not store your card details.

Auto-renewal: If auto-renewal is enabled, your subscription is automatically charged at the end of each billing period. If auto-renewal is disabled, your subscription expires at the end of the current period with no further charge.

Failed payments result in immediate subscription expiry and loss of apigw access. Access is maintained until the licence period ends; it is then automatically revoked.

Any pricing changes will be communicated before your next renewal date and will not affect the current billing period.

5. Free Trial

New users are entitled to a 7-day free trial. The trial period begins when the user creates a trial subscription by selecting the "Try for Free" option — it does not start automatically upon registration. All platform features are available during the trial period.

  • Auto-renewal on: At the end of the trial, your selected subscription plan is charged automatically.
  • Auto-renewal off: At the end of the trial, service access ends with no charge.

The free trial may only be used once per person or business. Creating multiple accounts to obtain additional trial periods is prohibited.

6. Acceptable Use

The platform may only be used for lawful commercial activities. The following are strictly prohibited:

  • Listing counterfeit, misleading or illegal products
  • Any activity that violates the terms of service of connected marketplaces
  • Placing excessive load on the platform or apigw infrastructure (DDoS, bot traffic, etc.)
  • Sharing API credentials with third parties
  • Reverse engineering the platform or apigw software (the GPL-licensed Plugin is exempt)
  • Transferring or selling account access to other persons or businesses
  • Automated scraping or crawling of the platform

Violations may result in account suspension or permanent termination, with or without prior warning depending on severity.

7. Marketplace Integration

The platform forwards requests to marketplace APIs on the User's behalf and relays the API response back to the User. In this process:

  • The User is notified whether the marketplace API accepted or rejected the request.
  • It is the User's responsibility to verify that requests have been correctly processed by the marketplace. For example, the User should independently confirm that prices, stock levels or product details have been updated as expected on the marketplace.
  • Keskintech is not liable for outcomes resulting from incorrect settings, misconfigured pricing rules or other errors made by the User.
  • Keskintech is not liable for marketplace API errors, outages or unilateral changes made by marketplace operators.

This clause applies within the context of a B2B relationship. Keskintech accepts no liability for indirect commercial losses (loss of profit, loss of revenue, reputational damage, etc.) arising from the User's trading activities.

8. Service Availability

Keskintech takes reasonable technical measures to maintain service continuity. However, the service is provided "as is" with no guarantee of any specific uptime level. The 99.9% uptime figure referenced in marketing materials reflects the SLA commitment of our infrastructure provider, Hetzner, and does not cover marketplace APIs or third-party services.

Keskintech is not liable for interruptions caused by:

  • Infrastructure provider (Hetzner) outages
  • Marketplace (Trendyol, Pazarama, etc.) API outages or changes
  • Cloudflare or other third-party service disruptions
  • Force majeure events (natural disaster, war, cyber attack, etc.)
  • Scheduled maintenance (announced in advance)

9. Intellectual Property

Plugin: The WordPress plugin published on WordPress.org is distributed under the GPL v2 licence. Your rights under the GPL cannot be restricted by these Terms.

Platform and apigw: The Keskintech Marketplaces brand, website design, API gateway software and all related intellectual property are owned by Keskintech. Access to the service under these Terms does not constitute a transfer of any such rights.

User data: All data submitted to the platform by the User — including product catalogues, pricing information and order data — remains the property of the User. Keskintech processes this data solely for the purpose of delivering the service.

10. Limitation of Liability

Keskintech's total liability under these Terms shall not exceed the total subscription fees paid by the User in the three (3) months immediately preceding the date of the claim.

Under no circumstances shall Keskintech be liable for:

  • Loss of profit, revenue or business opportunity
  • Losses resulting from marketplace listing errors
  • Losses arising from User misconfiguration
  • Losses resulting from decisions made by third-party marketplace operators
  • Indirect, incidental or punitive damages

11. Suspension & Termination

Termination by the User: You may cancel your subscription at any time. Your access continues until the end of the current billing period. For early refund eligibility, see our Refund Policy.

Suspension by Keskintech:

  • Subscription expiry: apigw access is revoked automatically upon licence expiry. No prior notice is required.
  • Policy violation: Depending on severity, Keskintech may issue a warning before suspending an account, or may suspend or permanently terminate an account immediately. Serious violations (fraud, infrastructure attacks, etc.) may result in permanent closure without notice.

Post-termination data: Following account closure, User data is handled in accordance with the retention periods set out in our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you by email to your registered address at least 14 days before the changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.

If you do not accept the changes, you may cancel your subscription before the effective date.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Turkey. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Istanbul (Çağlayan) Courts and Enforcement Offices.

Users residing in the European Union or European Economic Area retain the right to benefit from the mandatory consumer protection provisions of their country of residence.
